How to make a claim

The most important matter to attend to initially is to ensure both that the accident is reported to the Police as soon as possible, and that the fact that you were injured in the accident is noted by the Police as soon as possible.

It is then imperative that a written claim be lodged in relation to your accident injuries with Allianz Australia Insurance Limited. Allianz acts for the Motor Accident Commission, which is responsible for all claims arising from injuries caused by the fault of drivers of South Australian registered motor vehicles.

It would be wise for you to consult solicitors prior to contacting Allianz, especially as Allianz may require you to complete a formal claim form.

Allianz should then pay your medical expenses as they fall due, to ensure that delays in you obtaining treatment are minimised, so as to assist your recovery from your injuries.

It is then wise to wait until your injuries have stabilised, before obtaining medical evidence in relation to the injuries, and then attempting to settle your claim with Allianz. Allianz is very often willing to engage in informal settlement conferences in this regard.

Court proceedings in relation to compensation claims for motor vehicle accident injuries need to be commenced within three years of the date of the accident. It is very important to remember this time limit should you be unable to settle your claim with Allianz or should your accident injuries not have stabilised within three years of the date of the accident.
